In the following Privacy and Cookies Notice (“Privacy Notice”), we provide you with information on the collection, use and processing of your personal data when using the website of Autogrill Schweiz AG and its individual companies and establishments in Switzerland.

Your trust is important to us. We take your right to data protection seriously and we are mindful of appropriate security and compliance with the valid legal regulations, including, where applicable, the EU General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection.

In this Privacy Notice, we describe the collection, processing and use of your personal data by Autogrill Schweiz AG when you use our website and our contact form, register for our newsletter, participate in contests and in our customer loyalty programs and surveys, as well as when you book/make reservations for restaurant or hotel services and ordering our products online or offline. At present, we do not use automated individual decision-making.

If you disclose data to us or share data with us about other individuals, such as family members, co-workers, etc., we assume that you are authorized to do so and that the relevant data is accurate. When you share data about others with us, you confirm that. Please make sure that these individuals have been informed about this Privacy Policy.

1. SCOPE AND PURPOSE OF THE DATA PROCESSING

1.1. When visiting our website www.autogrill.ch

When you visit our website www.autogrill.ch as well as the websites of our various companies in Switzerland, the following access data – the navigation data – are recorded and deleted by us after 12 months at the latest:

  • Your IP address
  • Date and time of access
  • The name and the URL of the file called up
  • The website from which the access is made
  • The operating system of your computer and the browser used

The collection and processing of your data is for the purpose of allowing you to use our website, ensuring system security and stability, enabling our website content offer to be optimised, for statistical purposes as well as to prevent attacks on our network infrastructure. We process the data based our legitimate interests in accordance with applicable law.

Providing us with the navigation data indicated above is necessary in order to allow you to use the website.

Failure to provide consent by clicking on the "Refuse" button located within the appropriate banner, or failure to choose at all will ensure the persistence of the “default settings” and allows navigation within the website in the absence of cookies.

We also use cookies when you visit our website; for further details, see Section 2 below.

1.2. Contact and communication by e-mail or via our contact form

When you contact us by e-mail, we collect your e-mail address and any other personal data you send.

When you contact us via the contact form of the site, you can add voluntary information that we’ll collect:

  • Your e-mail address
  • Your name
  • Your address and
  • Your telephone number

in order to answer your contact request. We do this based on your consent given by sending these data to us and on our legitimate interest.

1.3. Newsletter

Your registration is necessary if you would like to subscribe to our newsletter. For this purpose, we require at least the following for data processing:

  • First name and surname
  • E-mail address

By registering, you consent to our processing of the data you provide to enable us to regularly send the newsletter to your address, and for the statistical evaluation of user behaviour and to optimise our newsletter.

This consent constitutes our legal basis for the data processing of your address and any other additional voluntary information in accordance with applicable law.

You are entitled to revoke your consent to receive the newsletter and to process your e-mail address at any time. You will find a corresponding link for this purpose at the end of each newsletter. Your personal data will be deleted after you unsubscribe from the newsletter.

We commission third parties to create, send and evaluate user behaviour for our newsletter and to transfer your data for this purpose.

We would also like to point out that we evaluate your user behaviour when the newsletter is sent. Our newsletter may use web beacons or tracking pixels or similar technical aids for this purpose. In the process, we record when you read our news-letter as well as which of its links you click.

We use the data thus obtained to create a user profile in order to tailor the newsletter to your individual interests.  We pay attention to the proportionality and reliability of the results and take measures against misuse of these profiles.

In order to disable tracking pixels, you can deactivate the display of images in your e-mail program by default. The tracking pixels will also be deleted with the deletion of the newsletter.

1.4. Participation in contests, loyalty or customer retention programmes and customer satisfaction surveys

We regularly provide you with the opportunity to participate online or offline in contests as well as loyalty or customer retention programmes and we conduct customer satisfaction surveys. You have the opportunity to participate voluntarily. In the event of your participation, we require some or all of the following personal data from you, depending on the competition or customer loyalty programme, in particular

  • Title and/or company
  • First name and surname
  • E-mail address
  • Postal address
  • Telephone number
  • Age
  • Driving license (category/number)
  • Occupation
  • Information about your preferences or experience with our products and services.

We will indicate the data that is absolutely necessary in each case. If this information is not provided, then participation in contests or customer loyalty programmes or customer satisfaction surveys is not possible.

In some cases, the data provided by you will be transferred to third parties, especially if we conduct contests or customer loyalty programmes or customer satisfaction surveys together with partners or suppliers. These partners or suppliers are carefully selected by us and are obligated to follow our instructions. If such  partners or suppliers qualify as third parties who pursue their own purpose with the data, they will be disclosed on a case by case basis in connection with contests as well as loyalty or customer retention programmes.

You have the right to revoke your consent to the processing of your personal data at any time by sending an e-mail to privacy.ch@autogrill.net or through the relevant website. If your revocation occurs before the conclusion of the contest or the customer loyalty programme or the customer satisfaction survey, then your revocation also means a revocation of participation. Revocation of consent does not, however, affect the lawfulness of the processing based on the consent prior to revocation.

1.5. Reservations and bookings of restaurant or hotel services, the ordering of goods

It is possible to make reservations and bookings on our website or on the website of our individual businesses, particularly restaurants or hotels.

It may be also feasible  that you can order goods via our online shop.

Depending on the type of service that you require, it may be necessary for us to  collect your personal data, which we need to make your reservation/booking or to process your order.

In particular, depending on the type of service you request, the following information is required:

  • Title
  • First name and surname
  • E-mail address
  • Postal address
  • Telephone number
  • Age
  • Credit card information

The mandatory details are specially indicated in each case, and additional information is voluntary.  We may also ask for health-related data, such as information about an allergy that we should know.

The legal basis for the data processing is the fulfilment of the reservation and/or services requested by you or the fulfilment of the contract in accordance with applicable law.

If you have given us your corresponding consent during the reservation/booking or ordering process, then we can also process the data that you have provided in order to send you further marketing information, in particular information about special offers or new products, either electronically (via newsletter, e-mail, SMS, social media) or by post. You have the right to revoke your consent to this further use of your data for the delivery of marketing information at any time. You will find a corresponding link in all marketing information sent to you in this manner.

In each case, your data will be forwarded to our company in Switzerland that is responsible for the provision of services, if the company itself has not collected the data. We may also transfer the personal data to external service providers appointed for performing the services such as reservation services providers, IT services providers, payment service providers for ensuring the payment process, including banks.

Due to legal requirements, we are obligated to store contract-relevant data for 10 years.

2. COOKIES

In addition to the data listed above, cookies, which are small text files, are automatically stored on your computer when you use our websites. Cookies cannot execute programs, transfer viruses to your computer or transmit personal data to us.

The purpose of cookies is to make your visit to our website easier and more pleasant. They enable us to better tailor the displayed information, offers and advertising to your individual interests and to recognise your computer when you visit our website again.

3. TRANSFER OF DATA TO THIRD PARTIES

We sometimes use external service providers to process your data for the purposes stated in this Privacy Policy such as payments service suppliers, reservation services providers, email service providers, cloud service providers, IT service providers, advertising agencies etc. and in order to provide our services. These are carefully selected and commissioned by us, and they are subject to our instructions and are monitored to ensure data security.

Moreover, we may transfer your personal data to companies that belong to the Autogrill Group as well as to third parties, if

  • You have consented to this;
  • We organise newsletters, contests, customer retention and loyalty programmes together with our partners;
  • This is necessary for the processing of a reservation, booking, order or payments or other contract performances in which we cooperate with partners or other service providers;
  • This is necessary for asserting our claims arising from your relationship with Autogrill Schweiz AG and its companies located in Switzerland and to defend our legitimate interests in the event of a dispute;
  • This is necessary for the analysis of your user behaviour on our website, or
  • There is a legal obligation to do this.

4. INTERNATIONAL TRANSFERS OF YOUR PERSONAL DATA

We normally store and process the personal data in Switzerland and/or in Italy and other EU / EFTA member states.  However, some of our service providers, partners or other providers commissioned by us as well as other companies in the Autogrill Group, to which we may transfer the personal data for the aforementioned purposes, are located abroad. Your data may therefore be processed outside of Switzerland. This includes both, countries within the European Economic Area and other countries abroad. If the recipient of the personal data is located in a country without a sufficient data protection level, e.g. USA, then we will implement contractual clauses, normally EU Standard Contractual Clauses,  or any other measures as may be required in order to   comply with  the applicable Swiss and/or EU data protection regulations.  An exception may apply for example in case of legal proceedings abroad, but also in cases of overriding public interest or if the performance of a contract requires disclosure, if you have consented or if data has been made available generally by you and you have not objected against the processing.

5. DATA SECURITY

In order to protect your data against manipulation, partial or complete loss and against unauthorised access by third parties, we take appropriate technical and organisational security measures. These are continuously improved in accordance with technological developments.

Our security measures also include the contractual involvement of our employees and contractual partners (e.g. service providers and external service providers etc.).

We only store personal data as long as it is required for the purpose for which it is processed or due to statutory retention obligations and where our legitimate interests in documentation and keeping evidence require it or storage is a technical requirement. The duration varies, depending on the type of data.
